A question we often hear is: "What ever happens to unpaid or unclaimed lockers?"
Well, Illinois Law requires us to follow a very strict procedure before we can 'evict' or 'clear out' an unpaid or "past due" space.
Once the locker is 45 days past due, we send 2 certified letters, (1 week apart) then we run a legal notice in the local paper, (once a week for 2 consecutive weeks) and then schedule an auction date and time. We will typically also advertise this event in a local paper.
The way the Illinois Self Storage Delinquent Unit Auction works is:
On the auction day, we open the unit door for all bidders to inspect the contents. Highest bid takes the whole locker. Cash, credit card, or other secure funds only of course. The Winning bidder is responsible for emptying the whole locker, and removing all contents from the premises. Typically we will allow 48hrs to empty the unit, all though depending on size and type, alternative arraignments may be made with the Auctioneer at his discretion.
Thats It. Winner takes all. Highest bid wins. That simple.
If the locker sells for more than the tenant owes, the tenant gets the difference. If it sells for less than owed, then that balance amount goes to collections.
